A maximum of 2 permits per calendar year may be issued to the same person or premises. The permit may not be transferred to another person or premises. No permit shall be approved and no sale shall be conducted for more than three consecutive days. Any changes to the permit must be made in person by the legal applicant. The sale shall be conducted between the hours of 7 a.m. and 5 p.m. on permitted days.
Verification of a valid garage/yard sale permit may be required during sale times. It is necessary to keep the original permit visible at site during sale times. Property for sale shall not be displayed within 5 feet of the public right of way. It is illegal to post any signs on any public property utility poles or telephone poles. This is a violation of California Penal Code Section 555 and 556.1. Actions of anyone carrying on any garage/yard sales, as defined by the ordinance, which fail to comply with the required conditions and provisions, shall be punishable by:
- A fine not exceeding $50 for the first violation
- A fine not exceeding $100 for the second violation within 1 year
- A fine not exceeding $200 for each additional violation within 1 year (Government Code Section 36900 (b).
The legal applicant may cancel this permit no later than 4:30 p.m. the day prior to the scheduled garage sale. Otherwise, the permit will be counted against the applicant's 2 sales per year. All property sold shall be household goods such as furniture, clothing and other miscellaneous household items only.
